Kjaer, who joined Wolfsburg in 2010, has had a fractious relationship with Magath and spent the whole of last season on loan to Serie A outfit Roma.
However, both sides have since failed to reach an agreement on a permanent deal, meaning the Denmark international is expected to return to training at Wolfsburg this week.
And while Kjaer himself has revealed he is not happy playing under Magath, his coach believes he has a contract with the club to honour.
"Kjaer has a contract with Wolfsburg, not with me," he told Bild.
"There are professionals whose comments would be a bit more clever in situations like this."
Kjaer made 24 appearances for Roma in all competition last season under coach Luis Enrique, who has since been replaced by veteran tactician Zdenek Zeman.
